EFFECTIVE JULY 1, 2002: CALIFORNIA RESTRICTIONS ON SOCIAL SECURITY NUMBERS

The California Confidentiality of Social Security Numbers statute became effective on July 1, 2002. The statute regulates certain uses of social security numbers, including requiring it for access over the Internet and printing it on documents or on credit cards.

The statute places restrictions on the following actions by any person or entity, not including a state or local agency:

  • Requiring the transmission of a social security number over the Internet;

  • Requiring the use of a social security number to access an Internet website;

  • Printing an individual’s social security number on any materials that are mailed to the individual; and

  • Printing an individual’s social security number on any card required for the individual to access products or services provided by the person or entity.

These restrictions are subject to certain exceptions. A person, or entity that has used, prior to July 1, 2002, an individual’s social security number in a manner inconsistent with the statute may continue using that individual’s social security number in that manner on or after July 1, 2002, if certain conditions are met.
