OHIO COMMON PLEAS COURT FINDS CLEVELAND PREDATORY LENDING ORDINANCE CONFLICTS WITH STATE LAW

The Court of Common Pleas of Cuyahoga County found the Cleveland predatory lending ordinance to be invalid as it conflicts with the general laws of Ohio. American Financial Services Association v. City of Cleveland, Case No. 467409 (C.P. Sept. 22, 2003). The court excluded provisions of the ordinance that prohibit the city of Cleveland from doing business with institutions that violate the state predatory lending law from its holding. The holding of the court followed the ruling of the common pleas court in Montgomery County that found the Dayton predatory lending ordinance was preempted by state law.
