PRESIDENT SIGNS “DO NOT CALL” REGISTRY BILLS

On February 20, 2003, the President signed into law the Omnibus appropriations bill, which provides funding to allow the Federal Trade Commission (“FTC”) to begin to develop a national “do not call” registry. On March 11, 2003, the President signed the Do‑Not‑Call Implementation Act, which authorizes the FTC to promulgate regulations under the Telemarketing Sales Rule (“TSR”) implementing the “do not call” registry. FTC Chairman Timothy J. Muris issued a statement indicating that the FTC would start building the registry, which should be fully functional and available to telemarketers by September.

The Do‑Not‑Call Implementation Act also requires the Federal Communications Commission to issue a final rule pursuant to the rulemaking proceedings it began on September 18, 2002 under the Telephone Consumer Protection Act and to consult and coordinate with the FTC to maximize consistency with the rule promulgated by the FTC.
